Hermanos:

El Parlamento de Pueblos Indígenas del Perú - PAI, organización de las comunidades campesinas y nativas - indígenas del Perú enmarca sus actividades en la Resolución de las Naciones Unidas del 13 de septiembre 2007 y en el Convenio 169 de la OIT sobre los pueblos indígenas aprobado el 27 de junio de 1989.

Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indigenas.

La ONU, mediante Resolución del 13 de septiembre del 2007.

El Convenio 169 de la OIT reconoce las aspiraciones de los pueblos indígenas a asumir el control de sus propias instituciones y formas de vida.

Constitución Política Del Perú

Artículo2° . - Toda persona tiene derecho 19. A su identidad étnica y cultural.

El Circuito Turistico Lucanamarca en Ayacucho en esta Semana Santa 2025, que será realizado el 17 y 18 de abril, que contemplan las Comunidades Campesinas de Tiopampa, Ccocha y Huarcaya, del distrito de Lucanamarca, provincia de Huanca Sancos y Despartamento de Ayacucho.

LEY DE COMUNIDADES CAMPESINAS

Artículo 1 .-

Declárese de necesidad nacional e interés social y cultural el desarrollo integral de las comunidades campesinas. El estado las reconoce como instituciones democráticas fundamentales, autónomas en su organización trabajo comunal y uso de la tierra, as+i cimi en lo económico y adminsitrativo, dentro de los marcos de la Constitución, la presente ley y disposiciones conexas.

Artículo 2 .-

Las comunidades Campesinas son organizaciones de interés público, con existencia legal y personería jurídica, integrados por familias que habitan y controlan determinados territorios, ligadas por vínculos ancestrales, sociales, económicos y culturales, expresados en la propiedad comunal de la tierra, el trabajo comunal, la ayuda mutua, el gobierno democrático y el desarrollo de actividades multisectoriales, cuyos fines se orientan a la realización plena de sus miembros y del país.

LEY DE COMUNIDADES NATIVAS

Artículo 8 ° .-

Las comunidades Nativas tienen origen en los grupos tribales de la Selva y Cejas de Selva y están constituídas por conjuntos de familias vinculadas por los siguientes elementos principales: idioma o dialecto, caracteres culturales y sociales, tenencia y usufructo común y permanente de un mismo territorio, con asentamiento nucleado o disperso.

Artículo 7 ° .-

 

El Estado reconoce la existencia legal y la personalidad jurídica de las Comunidades Nativas.

Artículo 9 ° .-

Son miembros de las Comunidades Nativas los nacidos en el seno de las mismas y aquellas a quienes éstas incorporen siempre que reúnan los requisitos que señale el Estatuto de Comunidades Nativas. Se pierde al condición de comunero por residir fuera del territorio comunal por más de 12 meses consecutivos, salvo que la ausencia sea motivada por razones de estado o salud debidamente acreditadas, por traslado al territorio de otra Comunidad Nativa de acuerdo a los usos y costumbres y por el cumplimiento del Servicio Militar. 

Artículo 10 ° .-

El estado garantiza la integridad de la propiedad territorial de las Comunidades Nativas, levantará el catastro correspondiente y les otorgará títulos de propiedad. Para la demarcación del territorio de las Comunidades Nativas, se tendrá en cuenta lo siguiente:

  1. Cuando hayan adquirido carácter sedentario, la superficie que actualmente ocupan para desarrollar sus actividades agropecuarias, de recolección, caza y pesca; y
  2. Cuando realicen migraciones estacionales, la totalidad de la superficie donde se establecen al efectuarlas.

Cuando posean tierras en cantidad insuficiente se les adjudicará el área que requieran para la satisfacción de las necesidades de su población.
